Booking Terms & Conditions

The purchase of your travel booking constitutes a contractual agreement between the traveler(s), customer(s), purchaser(s) and/or anyone traveling under the same booking (collectively as "You", “Your”, "Client"), and Starglow Travel LCC ("We", "Us", “Our”, “Agency”) pursuant to the following booking terms and conditions ("Terms").


The Agency is an independent travel agency that contracts with third party suppliers (each a “Supplier” and collectively, “Suppliers”) as a booking agent to provide travel products including tours, cruises, hotels, airline tickets and rental cars (“Travel Services"). The Suppliers providing tours, excursions, transportation, accommodations and other components of your trip or vacation are independent contractors and are not agents, affiliates, representatives, or employees of the Agency. All documentation, receipts, confirmations, and tickets issued are subject to the terms and conditions specified by the Supplier.


All reservation services provided and Travel Services coordinated by us are subject to the Terms. Travel Services are not directly supplied by the Agency. The Agency, therefore, shall not be responsible for breach of contract, failure to comply with any laws such as the Americans with Disabilities Act (ADA), cancellations, interruptions, or any intentional or negligent actions or omissions on the part of the suppliers of Travel Services, which result in any loss, damage, delay, inconvenience or injury to travelers or travelers’ companions or group members.


By booking a reservation through the Agency, you have agreed to and have accepted the Terms. The Terms take precedence over Supplier terms and conditions. Each Supplier is an independent entity with its own management and is not subject to control by the Agency.


The Terms are subject to change at any time, without prior written notice.


Online check-in prior to travel


Suppliers, such as cruise lines, may require that you pre-register and check-in through their website prior to travel. For cruises, if you have not completed online check-in, you will be required to complete the information at the pier at least several hours prior to the published sailing time. All guests must be checked in and onboard the ship no later than 90 minutes prior to the published sailing time or will be refused the ability to sail and may not be entitled to a refund.


Cancellation


You fully understand and acknowledge that Travel Services can be interrupted or canceled by your travel provider, a government entity, or another third party outside the Agency's control for reasons unforeseeable at the time of booking. If travel plans are delayed, interrupted or canceled for any reason, there will be no refunds issued by us. You understand and acknowledge that the Agency has no control over a Supplier's policies, which in addition to applicable law, will solely govern any cancellation, rebooking, and refund related to the Travel Services. Additionally, you acknowledge that Supplier vaccination policies may change even after a booking is made. Information regarding a Supplier’s cancellation and vaccination policies can be found on the Supplier’s invoice or statement provided to you, and may also be found online by visiting the Supplier’s website directly. There will be no refunds due to fear of travel from actual or threatened terrorist events. We are not liable for the acts or omissions of any Supplier. You understand and acknowledge that, if applicable, the travel insurance policy obtained by you to cover Travel Services will dictate any coverage for financial loss resulting from interruption or cancellation of the travel services. 


Risks


U.S. Government requirements are constantly changing regarding passport requirements for cruise travel outside the U.S. and U.S. domestic travel. We strongly recommend confirming your travel documentation needs with the proper government agencies at www.travel.state.gov. Foreign nationals should contact their government for further details and requirements. Clients traveling without proper documentation may be denied boarding and will not be entitled to a refund.


You acknowledge that traveling involves the risk of a variety of hazards to health and/or safety, including but not limited to, injury, illness, disease, epidemics, and/or pandemics, including exposure to COVID-19. You expressly understand and agree that you assume all such risks associated with traveling whether or not specified herein. 


Clients traveling by air with identification (ID) that does not meet the REAL ID ACT requirements will have to use alternate ID forms (passport, military ID, or permanent resident card) to pass TSA security checkpoints - even for domestic travel. Please visit www.travel.state.gov or https://www.dhs.gov/real-id for the most updated requirements for travel documentation. Visas are required when they apply.


Federal law forbids the carriage of certain hazardous materials, such as aerosols, fireworks, and flammable liquids, aboard the aircraft. If you do not understand these restrictions, contact your airline or go to http://www.faa.gov/about/initiatives/hazmat_safety/.


For information concerning possible dangers at international destinations, you can visit the State Department’s online travel advisory service: http://travel.state.gov/travel/warnings.html. For medical information, visit the U. S. Centers for Disease Control website at www.cdc.gov./travel. You assume complete and full responsibility for, and hereby release us from any duty to investigate or inform you as to possible dangers, dangerous conditions, diseases and other hazards associated with your destination.


Travel protection insurance


Travel protection insurance is highly recommended to help protect your investment and provide assistance in a travel emergency or any other unforeseen circumstance that could affect your travel plans, such as delays, interruptions, cancellations, and default by the travel provider. This is especially important if traveling abroad. The Agency can provide you with a quote for travel insurance and you must accept or decline this insurance in writing. 


Client Incentives


Any incentive offered to you by the Agency, such as onboard credit, shall be applied to your travel booking 14 to 30 days before the date of travel listed in your travel booking. The Agency shall not be responsible for any lost, stolen, damaged, or destroyed checks issued by the Agency. A new check shall not be reissued to you.


Disclaimer


You assume complete and full responsibility for, and hereby release the Agency from, any duty of checking and verifying any and all passport, visa, vaccination, or other entry requirements of each destination, and all safety and security conditions of such destinations, during the length of the proposed travel. It is the Client’s responsibility to have proper passports or government issued IDs where permitted.


The Agency does not guarantee any of such Supplier’s rates, bookings, reservations, connections, scheduling, or handling of baggage or other personal effects. The Client has done due diligence, is aware of the quality of the hotel accommodations chosen, and agrees to release and hold the Agency harmless for any claims, liabilities, or losses relating to the quality of accommodations and services of a Supplier, and any delays, changes, or cancellations of any reservation or booking.


The Agency shall not be responsible for, and you expressly release and hold us harmless from, any injuries, losses or damages in connection with terrorist activities, social or labor unrest, mechanical or structural integrity of air, sea, and ground transportation and accommodations, diseases, epidemics/pandemics, local laws, terrorists acts, bankruptcy or cessation of Supplier or carrier services, Supplier default, climatic conditions, delays, interruptions, changes or cancellation of travel, including cancellations due to weather conditions, hotel services, accidents or health related problems before or while in-transit to (e.g., an accident on the way to a tour), during, and after a tour, or any other actions, omissions, or conditions outside of our control.


By embarking upon their travel, the Client voluntarily assumes all risks involved in such travel, whether expected or unexpected. The Client is hereby warned of the above risks as well as possible travel industry bankruptcies and medical and climatic disruptions, and the possibility the Client may be unable to travel as scheduled because of personal emergency.


Port, air, and government taxes are subject to change at any time. Suppliers may reserve the right to reinstate fuel surcharges at their discretion and without notice.


The Client’s retention of tickets, reservations, or bookings after issuance shall constitute consent to the above and an agreement on their part to convey the contents hereto to their travel companions or group members.


COVID-19 Assumption of Risk, Waiver of Liability & Indemnity Disclosure


In consideration of the travel opportunity presented to you by the Agency and afforded to you by the Suppliers, the Client, by applying payment on travel considered herein, acknowledges and agrees to the following:


The 2019 Novel Coronavirus (“COVID-19”, “Coronavirus”, “Pandemic”) is a known and rapidly evolving pandemic that is affecting travel worldwide, with continued spread and impacts expected.


The Client is fully aware of the current global COVID-19 virus outbreak, the current travel restrictions, and inherent risks involved if choosing to travel.


The Client understands that it is their responsibility to check, understand, and comply with the latest travel information regarding this virus outbreak with the CDC (https://wwwnc.cdc.gov/travel/notices), domestic governing bodies (https://travel.state.gov), destination governing bodies, and all Suppliers associated with the Client’s travel.


The Client is aware that it is their personal decision to travel and is doing so with full knowledge of current travel recommendations, restrictions, and requirements with regards to COVID-19 and takes full responsibility for their actions with regards to this.


The Client understands and confirms that the Agency, after reasonable inquiry, has made available to the Client, by reference, referral, or other conveyance, the best available information known to the Agency regarding pandemic policies provided by the Suppliers, governing bodies, or any other entity involved in the Client’s booking.


The Client is aware of the travel warnings, travel restrictions and rules including screening and use of masks, travel insurance restrictions, and restrictions that may impede the Client’s ability to enter or exit a destination as planned, related to COVID-19 and understands the risks, is accepting of these and holds the Agency harmless for any travel restrictions, death, illness, cancellations by the Suppliers, financial loss, quarantining rules or measures put in place at airports or destinations the Client is traveling through. The Client further agrees to hold the Agency harmless for any financial penalties or fees imposed by the Suppliers due to cancellations or postponements due to COVID-19 and agrees not to sue or institute a credit card dispute or chargeback to the Agency or its partners for said penalties, fees, or real or alleged damages.
