Please carefully read the Terms of Use (the “Terms”) for the website located at www.starglowtravel.com (the “Website”) including its sub-domains and mobile optimized version, as set out hereinafter. The Website is owned and operated by Starglow Travel LLC, a California limited liability company registered in the United States (hereinafter referred to also as “Company”, “we,” “us” or “our”). Any ancillary terms, guidelines, the Privacy Policy (the “Policy”) and other documents made available by the Website from time to time and as incorporated herein by reference, shall be deemed as an integral part of the Website. These terms set forth the legally binding agreement between you as the user(s) of the Website (hereinafter referred to as “you”, “your” or “User”) and the Company. If you are using the Website or its services on behalf of an entity, organization, or company (collectively “Subscribing Organization”), you declare that you are an authorized representative of that Subscribing Organization with the authority to bind such organization to this Website; and agree to be bound by this Website on behalf of such Subscribing Organization. In such a case, “you” in these Terms refers to your Subscribing Organization, and any individual authorized to use the Service on behalf of the Subscribing Organization, including you.

We do not permit users under the age of 18 to use the Website. You represent that you are over the age of 18.

By using Company provided services, accessing, or using the Website in any manner as laid down herein, including, but not limited to, visiting or browsing it, or submitting content or other materials to it, you agree to be bound by these Terms.

These Terms, granted hereunder, may not be transferred, or assigned by you, but may be assigned by the Website without restriction. Any attempted transfer or assignment in violation hereof shall be null and void.

Each time by viewing, using, accessing, or browsing, or submitting any content or material on the Website, including the webpages contained or hyperlinked therein and owned or controlled by the Website and its services, whether through the Website itself or through such other media or media channels, devices, software, or technologies as the Website may choose from time to time, you are agreeing to abide by these Terms, as amended from time to time with or without your notice.

The Website may also, in its sole and absolute discretion, choose to alert via email all users with whom it maintains email information of such modifications.

Also, occasionally there may be information on the Website or within its services that contains typographical errors, inaccuracies or omissions that may relate to service descriptions, pricing, availability, and various other information, and the Website management reserves the right to correct any errors, inaccuracies, or omissions and to change or update the information at any time, without prior notice.

Website Services

The Website displays information about travel locations, airfares, travel agents’ locations, flight times and dates, tours, packages, insurance, cruises, transportation, foreign currency, schedules, travel companies and many other things.

This information is supplied to us by third party providers; such are airlines, hotels and transportation suppliers ("Service Providers"). We have taken reasonable care to ensure it is correct and up to date; however, we cannot check the accuracy of such information.

Many of the services which made up your travel booking are provided by Service Providers. The Service Provider provides these services in accordance with their own terms and conditions. Some of these terms and conditions may limit or exclude the supplier's liability to you.

We accept no responsibility for information supplied to us by Service Providers. We recommend you confirm all information contained on or linked from the Website with the third-party provider.

The details of the prices, packages, tours, flights and other information displayed on the Website are subject to change without notice. The travel products and services described on the Website are subject to availability.

Prices

Much of the content on the Website is supplied to us by third party Service Providers. Although we take reasonable care to ensure all content on this Website is correct and up-to-date, we cannot check the accuracy of all such information as provided by the Service Providers.

The Service Providers may change their prices, details of their packages, tours, flights and other information displayed on the Website at any time. For this reason, all prices displayed on the Site are subject to change without notice.

All travel products and services described on the Website are subject to availability. Special conditions may apply to the prices set out on the Website. To determine such conditions, you must contact us or the relevant Service Provider. In addition to the prices set out in the Website, you may be required to pay certain taxes, government fees and other charges payable on the room, tour or car rental.

Suitability of Travel Products and Services

We do not represent that any travel products and services set out on the Website will be suitable for you. You release us from any claims in relation to the travel products and services described on the Website, including but not limited to claims that the travel products and services are not suitable. Service Providers are independent parties over which we have no control. The information and description given about the Service Providers and their products are based on our inquiries and are believed to be accurate, but we cannot guarantee in respect thereof.

The Website includes hyperlinks to other websites owned and operated by third parties; such hyperlinks are not recommendations. Goods and services of third parties may be advertised and/or made available on or through the Website. Representations made regarding products and services provided by third parties are governed by the policies and representations made by these third parties. The Website is not responsible for any software, data, or other information available from any third party website. It is our policy not to accept information that is confidential or proprietary, other than travel arrangements and bookings. If you do not want to lose confidentiality in your material, do not submit it via the Website, email it or send it to us.

You agree not to copy, modify, adapt, reproduce, translate, distribute, transmit, reverse engineer, frame, decompile or disassemble any aspect of the Website. All content and materials, such as images, photographs, graphics, texts, forms, lists, charts, guidelines, data, logos, code, icons, videos, audio, and other content are the property of, are licensed to or are otherwise duly available to Company, its affiliates, its licensors or to the appertaining third party copyrights holder.

You acknowledge and agree that any and all infringing use or exploitation of copyrighted content on the Website and its services may cause us, our affiliates, licensors or content providers irreparable injury, which may not be remedied solely at law, and therefore our affiliates, licensors or content providers may seek remedy for breach of the Website, either in equity or through injunctive or other equitable relief.

Original images, original writings, photos or other intellectual property posted by us is copyrighted and protected under U.S. law.

Copyright

If you believe that materials hosted by us infringe your copyrighted materials, you (or your agent) may send us a written notice of such infringement that includes all of the following information:

• Identification of the copyrighted work or works that the copyright holder claims have been infringed;

Your use of the Website is at your own risk, and therefore you hereby acknowledge and agree that the Website is provided “as is”, “with all faults”, and “as available”, including all content, guides, checklists, reference guides, sample filing forms, software, materials, services, functions and/or information made available thereby. It shall be your own responsibility to ensure that the Website or information available through the Website meet your specific requirements.

Neither the Company, nor its affiliates, subsidiaries, officers, employees and agents warrant that the Website will be error-free, uninterrupted, secure, or produce any particular results; or that any listing, purchase, order, amount, information, guide, sheet, checklist and/or content will be current, measured useful and/or valid, or that it will produce any particular results or that the information obtained therefrom will be reliable or accurate. No advice or information given by the Company or its employees, affiliates, contractors and/or agents shall create a guarantee. The aforementioned limitation of damage liability, shall be in force regardless of however caused or however awarded, regardless of the theory of liability applied (including contract, warranty or tort), whether active, passive or imputed, including negligence, strict liability, product liability or other legal theory, regardless of the product or service offered by action or inaction by merchant; and even if you have been advised of such possibility.

To the fullest extent allowable under applicable law, the Company hereby expressly disclaims any and all representations and warranties of any kind with respect to the Website, including any and all liability arising out of or related to any purported facts or information and description of any information, products and/or services displayed on the Website, including all warranties of any kind, whether express or implied; including, without limitation, warranties of title, merchantability, accuracy, completeness, condition, quality, durability, performance, accuracy, reliability, suitability, fitness for a particular purpose or non-infringement.

Indemnification

You agree to indemnify, defend and hold the Company and its affiliates, officers, employees and agents against all losses, costs, damages, claims and expenses arising from:

• any act or omission by you or an officer, employee or agent of you;

• Any claim, action, demand or proceeding by a third party against us or our officers, employees or agents caused or contributed to by you or an employee or agent of you.

Privacy

We will handle your personal information in accordance with the terms and conditions set out in our Privacy Policy on the Website. We and our third-party providers of travel and travel related products and services may disclose your personal information to others where directly connected with facilitating your travel arrangements and bookings and the provision of travel services and products. For example, we may disclose your personal information to airlines, hotels, car rental companies and other service providers in facilitating your travel arrangements.

At all times we retain the right to monitor, retain and disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request.

We may disclose aggregated information about users and use statistics relating to the Website and aggregated information about our sales and trading patterns to others.

We may disclose your personal information to Service Providers for the purpose of booking your travel.

Our Relationship

No agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship is intended to be created between you and us by these Terms.

Amendments

Except as otherwise specified, we may amend these Terms at any time without notice to you by posting amended Terms on the Website. The amended Terms will take effect immediately.

Generals

Headings. The titles of paragraphs in these Terms are shown only for ease of reference and will not affect any interpretation therefrom.

No Waiver. Failure by the Company to enforce any rights hereunder shall not be construed as a waiver of any rights with respect to the subject matter hereof.

Notices. All legal notices or demands to or upon the Company shall be made in writing and sent to the Company personally, by email, courier, or certified mail, and shall be delivered to any address the parties may provide. For communications by email, the date of receipt will be the one in which confirmation receipt notice is obtained. You agree that all agreements, notices, demands, disclosures and other communications that the Company sends to you electronically satisfy the legal requirement that such communication should be in writing. 

Severability. If any provision of the Terms is held unenforceable, then such provision will be modified to reflect the parties’ intention. All remaining provisions of the Terms will remain in full force and effect. The failure of either party to exercise in any respect any right provided for herein will not be deemed a waiver of any further rights hereunder.
